Terms of Service

These Terms of Service ("Terms") govern your access to and use of GHOBZ LLC's website design and maintenance services ("Services"). By purchasing our Services, you agree to these Terms. If you do not agree, do not purchase or use our Services.

GHOBZ provides the following as part of your subscription:

• A custom website designed and deployed within 48 hours of intake completion
• Connection of your domain to the delivered site
• Up to 2 change requests per day via your dedicated Slack channel
• Unlimited bug fixes and issue resolutions
• Monthly site maintenance and updates
• Hosting on Vercel infrastructure

Services are subject to intake completion. GHOBZ will not begin building your site until all required business information has been provided via the onboarding process.

• Setup fee: $500 USD, charged once at checkout
• Monthly subscription: $100 USD/month, billed automatically via Stripe on the same date each month
• All prices are in US dollars and exclude any applicable taxes
• Your subscription renews automatically each month until you cancel (see Cancellation)

By completing checkout, you authorize GHOBZ to charge the setup fee immediately and your payment method on a recurring monthly basis until cancellation.

If you are not satisfied with your delivered website, you may request a 75% refund of the $500 setup fee within 30 days of your purchase date.

The guarantee applies to the one-time setup fee only. The following are not covered:

• Monthly subscription payments
• Requests submitted after the 30-day window

To request a refund, email hello@ghobz.com within 30 days of purchase. Refunds are processed within 5–10 business days via the original payment method.

You may cancel your subscription at any time by messaging your dedicated Slack channel or emailing hello@ghobz.com.

Upon cancellation:

• Your subscription will not renew at the next billing date
• Your website will remain live and accessible for 30 days after the cancellation date
• After 30 days, your site will be taken offline and removed from our infrastructure
• Website source files are not transferred to you upon cancellation
• You are responsible for migrating any domain DNS settings if needed

No partial-month refunds are issued on the monthly subscription.

GHOBZ retains all ownership of website code, templates, design systems, and infrastructure used to build and host your site.

You retain full ownership of all content, brand assets, copy, images, logos, and other materials you provide to us. You grant GHOBZ a non-exclusive license to use these materials solely to build and maintain your website.

GHOBZ may display your website in our portfolio unless you request otherwise in writing.

You agree not to use our services to:

• Promote illegal, fraudulent, or deceptive products or services
• Violate any third party's intellectual property rights
• Distribute spam, malware, or phishing content
• Violate any applicable local, state, or federal laws

GHOBZ reserves the right to suspend or terminate your service immediately, without refund, if your use violates this section.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOBZ'S TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO GHOBZ IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.

GHOBZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOST PROFITS, OR LOSS OF DATA, EVEN IF GHOBZ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Services are provided "as is" and "as available." GHOBZ does not warrant that the Services will be uninterrupted or error-free.

GHOBZ does not guarantee specific outcomes including but not limited to: search engine rankings, website traffic volumes, lead volumes, or conversion rates.

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.

GHOBZ may update these Terms at any time. Material changes will be communicated via email to active customers at least 14 days before taking effect. Continued use of the Services after that date constitutes acceptance of the updated Terms.
