The short answer
Market a new residential development in stages. Confirm the law lets you advertise yet, build an interest list before sales open, publish real unit facts, run ads inside housing rules, and shift the message from pre-construction to tours to lease-up. Start early, because current absorption data shows the market gives little help.
How hard is it to sell or lease new housing right now?
Hard enough that you should plan for slow absorption. Census survey data reported by NAHB shows 41% of apartments completed in Q1 2026 were absorbed within three months, the seventh straight quarter below 50%. Older cohorts reached 69% at six months, 81% at nine and 89% at twelve. The three-month rate for new condos and co-ops was 70%, on just 3,879 completions. The survey covers buildings with five or more units.
For-sale builders face similar pressure. In NAHB's October 2026 survey, 43% of builders cut prices, the average cut stayed at 6%, 65% used incentives, and the buyer traffic index fell to 18. Census and HUD counted 476,000 new homes for sale at the end of September, an 8.4 month supply. Of those, 115,000 had not started construction.
Rates and supply are outside your control. Demand you build ahead of delivery is the part you can influence.
When can a developer start advertising?
Ask counsel before anything goes public, because the rules vary by state and product. Three examples show the range:
- New York. General Business Law 352-e says no offer, advertisement or sale of these securities may be made until the attorney general has issued a letter stating the offering has been filed. That reaches condo and co-op offerings, and it covers advertising, not only contracts.
- California. The Department of Real Estate says subdivision laws cover most standard subdivisions and common interest developments of 5 or more lots or units. Ask counsel what you may say, and when.
- Federal land sales. The Interstate Land Sales Act exempts sales of land with a building on it, and sales obliging the seller to build within two years, among others. Subdivisions under 100 lots and many condo units escape only its registration and disclosure duties, so lot sellers should have counsel check.
What does each stage of a development campaign need?
Each stage asks a different thing of the buyer or renter, so the content and the measure change. Skip any stage your counsel has not cleared.
| Stage | Goal | Main work | Measure |
|---|---|---|---|
| Before sales open | An interest list, where allowed | Project site, area story, form, reply plan | Qualified names by source |
| Pre-construction | Reservations or contracts, as allowed | Floor plans, pricing sheet, broker outreach, private previews | Appointments and deposits |
| During construction | Keep the list warm | Milestone updates, framing and topping out, delivery dates | Reply rate, list decay |
| Grand opening | Fill the tour calendar | Model or sales center, local ads, booking links | Tours booked and held |
| Lease-up or sell-out | Hit the monthly pace | Availability pages, retargeting where allowed, referrals | Units per month against plan |
What should a project website show?
It should answer the questions a buyer would otherwise call the sales center for. A render and a brochure PDF leave most of them open. Publish these as plain web pages that people, search engines and assistants can read:
- Unit mix and floor plans by unit type.
- Availability, with prices or ranges if you and counsel are comfortable publishing them.
- Delivery date, and how firm it is.
- Deposit terms and the steps to reserve or apply.
- Site plan, parking, fees and association costs.
- A short form that books a tour, and a staffed reply after the sales center closes.
How do housing ad rules change paid media?
They remove the targeting most ecommerce playbooks rely on. Housing ads run with limited audience tools on both big platforms, so creative and landing pages carry more of the weight. This table comes from Meta's developer documentation and Google's personalized advertising policy. Check both before launch, since they change.
| Setting | Meta housing ads | Google housing ads |
|---|---|---|
| Age and gender | Age generally fixed at 18 to 65+. Gender cannot be chosen | Age, gender, marital and parental status may not be used in the US and Canada |
| ZIP targeting | Not supported | Cannot be used in the US and Canada |
| Radius | At least 15 miles in the US and Canada | Radius, city and country targeting allowed |
| Lookalikes | Unavailable | Check the current policy |
How do you plan the numbers and keep ads legal?
Work back from the pace in your pro forma. Here is an example with made-up inputs: 120 units leased over 12 months means 10 a month. If a quarter of tours sign, you need 40 tours a month. If half of qualified leads tour, you need 80 leads a month. Replace each number with your own as data comes in, and watch the step that falls short.
Fair Housing applies to every asset. 24 CFR 100.75 covers words, photographs and illustrations that convey a preference, and media choices that deny groups information. Renders full of one kind of family are a risk. Read our notes on fair housing advertising with your counsel. If you run a staffed sales center, look at Google's profile rules for agents and offices too.
